Is my mediator accredited? Why is this important?
Unlike the health sector where the use of titles, such as surgeon, are protected and governed by law, anyone can use the title mediator.
So how can you be sure that someone who holds themselves out as a mediator is appropriately skilled and qualified?
The first place to start is the Mediator Standards Board (MSB).
They hold “the only authoritative list of mediators accredited” under the National Mediator Accreditation Scheme (NMAS).
An NMAS accredited mediator must be of good character, meet a minimum standard of training and assessment and comply with professional standards of practice.
Accredited mediators are required to maintain a high level of skills and experience and must hold professional indemnity insurance that covers their work.
They must also reapply for accreditation every two years - ensuring their knowledge and skills are current and best practice.
In addition to these checks and balances, there is also a formal complaints handling mechanism which the public can turn to if they have concerns about the conduct of a mediator. Complaints can be made to a recognised Mediator Accreditation Body affiliated with the MSB.
To confirm the accreditation status of a mediator, search the online, easy-to-use NMAS database.
Some mediators may also be practising lawyers. These credentials can also be verified by undertaking a search of the relevant state law society register of solicitors.
Most importantly, regardless of which party identifies a mediator, both parties must agree on the person selected, before the mediation can commence.
